Section 3: THE ENERGY CONSERVATION PROMOTION FUND COMMITTEE
3.1 In order to effectively achieve the energy conservation objectives, the Energy Conservation Promotion Act, B.E. 2535 (1992), Section 27, stipulates that the Energy Conservation Promotion Fund Committee (the ENCON Fund Committee) be appointed and entitled with duties and authority as stated in Section 28, as follows:

Director-General of the Department of Energy Development and Promotion Member 8. Director-General of the Public Works Department Member 9. Director-General of the Industrial Works Department Member 10. President of the Federation of Thai Industries Member 11. President of the Engineering Institute of Thailand under H.M. the King’s Patronage Member 12. Qualified persons (not more than seven, appointed by the Cabinet) Member 13. Secretary-General of the National Energy Policy Office Member and Secretary Duties and Authority
- To propose to the NEPC guidelines, criteria, conditions and priorities for the disbursement of funds in accordance with the objectives prescribed under Section 25 of the Energy Conservation Promotion Act, B.E. 2535 (the ENCON Act).
- To allocate appropriations from the ENCON Fund in accordance with the objectives prescribed in the ENCON Act, and ensure that they conform to the guidelines, criteria, conditions and priorities prescribed by the NEPC.
- To prescribe regulations on the criteria and procedures for applications, grants allocations or subsidies from the ENCON Fund.
- To propose to the NEPC remittance rates to be imposed on petroleum for the ENCON Fund.
- To propose to the NEPC the types of petroleum that will be exempted from these rates.
- To prescribe surcharge rates which are subject to the approval of the NEPC and determine exceptional cases where surcharges should be exempted.
- To consider for approval requests for financial assistance/or support to promote energy conservation projects in accordance with the guidelines, criteria and conditions prescribed by the NEPC.
- To prescribe the criteria and procedures for requests for assistance and/or support.
- To carry out other duties as prescribed under the ENCON Act.
3.2 For the seven qualified persons to be appointed members, as mentioned in Item 3.1 above, Sections 27 and 29 of the ENCON Act stipulate that the selection be made from persons with expertise, experiences and past achievement in the fields of economics, finance, energy technology, and environment. The term of office is three (3) years.
3.3 Based on the authority given in Section 34 of the ENCON Act, the ENCON Fund Committee has a resolution to appoint three Sub-Committees to assist with the tasks of the ENCON Fund Committee by screening projects/proposals and other relevant matters prior to submission to the ENCON Fund Committee. Each Sub-Committee is entitled to deliberate and approve projects with budgets that do not exceed 10 million baht each. The three Sub-Committees are the following:
- The Sub-Committee on the Compulsory Program – to screen the work under the Compulsory Program prior to submission to the ENCON Fund Committee;
- The Sub-Committee on the Voluntary Program – to screen the work under the Voluntary Program prior to submission to the ENCON Fund Committee; and
- The Sub-Committee on the Complementary Program – to screen the work under the Complementary Program prior to submission to the ENCON Fund Committee.
In addition, the ENCON Fund Committee has appointed the Sub-Committee on the Energy Conservation Program Implementation Evaluation to assist with the evaluation of the implementation outcome of each funded project.
