
EMERGENCY DECREE
ON
REMEDY AND PREVENTION OF SHORTAGE OF FUEL OILS.

Given on the 26th day of February B.E. 2516;
Being the 28th Year of the Present Reign.
His Majesty King Bhumibol Adulyadej is graciously pleased to proclaim that:
Whereas the price of crude oil in the world market has been increased from time to time and the quantity of crude oil available is decreasing resulting in the rise of prices of the fuel oils in the country and shortage of fuel oils in Thailand, therefore, it is necessary, in order to maintain the national security and well-being of the people, to proceed to remedy and prevent the said situation forthwith and to empower the Prime Minister to take immediate measures in this matter so that the Ministries, Sub-Ministry and Department may not have to execute the existing laws separately;
By virtue of Section 15 of the Constitution of the Kingdom B.E. 2516, the King hereby issues the Emergency Decree as follows:
Section 1 : This Emergency Decree is called the "Emergency Decree on Remedy and Prevention of Shortage of Fuel Oils, B.E. 2516".
Section 2 : This Emergency Decree shall come into force as from the date of its publication in the Government Gazette.
Section 3 : For the purpose of remedying and preventing the shortage of fuel oils, the Prime Minister has the power to issue order determining measures on the following matters:
(1) the production, distribution, transportation, possession, reserve, export and import of all kinds of fuel oils;
(2) the production or distribution of electric energy or other energy:
(3) the consumption of fuel oils, electric energy or other energy or the carrying out of business which must use fuel oils, electric energy or other energy such as
(a) to determine the days, hours and conditions in connection with the carrying out of business of factories;
(b) to determine the opening and closing days and hours and the conditions in connection with the carrying out of business of entertainment houses, theatres, service providing establishments, restaurants or other entertainment places,
(c) to determine the days, hours and conditions in connection with the use of vehicles, regardless of being vehicles used for public purpose or private vehicles;
(d) the consumption of electric energy within buildings, in the advertisements and within other places.
(4) the rationing of all kinds of fuel oils.
In the execution of paragraph one, the Prime Minister shall have the power to authorize, subject to any condition, any person or a committee appointed by the Prime Minister to do so on his behalf.
The order of the Prime Minister or the person authorized by the Prime Minister given under paragraph one in so far as the public are concern and the order of authorization of the Prime Minister under paragraph two shall be published in the Government Gazette.
Section 4 : After having given any order under Section 3, the Prime Minister shall inform the Council of Ministers of it, and, after having taken any measure under this Emergency Decree, the Prime Minister shall inform the Council of Ministers of it from time to time.
Section 5 : The Prime Minister or the person authorized by the Prime Minister shall have the power to appoint the competent officials for the execution of this Emergency Decree.
Section 6 : The person and committee authorized by the Prime Minister under Section 3 paragraph two and the competent officials appointed under Section 5 shall be officials under the Penal Code.
Section 7 : In the execution of their duties, the persons under Section 6 shall have the power to enter any place or to instruct any person to give facts or furnish them with any documents.
Section 8 : Any person who violates or fails to comply with the order of the Prime Minister or that of the person authorized by the Prime Minister given under Section 3 shall be liable to imprisonment for a term not exceeding ten years or to a fine not exceeding one hundred thousand Baht or to both.
Section 9 : Any person who fails to comply with the order given under Section 7 or obstructs or does not provide facilities to the person authorized by the Prime Minister or to a competent official in the execution of his duties shall be liable to imprisonment for a term not exceeding six months or to a fine not exceeding five thousand Baht or to both.
Section 10 : This Emergency Decree shall come into operation for a period of one year.
Section 11 : The Prime Minister shall have charge and control of the execution of this Emergency Decree.
